\u201cThis administration is devastating one of our nation\u2019s fastest-growing sources of clean, reliable, and affordable energy,\u201d New York Attorney General Letitia James said in a\u00a0press release.<\/a><\/p>\n

The suit claims that Trump has attacked wind energy in an \u201carbitrary and capricious\u201d way. It invokes the\u00a0Administrative Procedure Act<\/a>\u00a0that allows courts to deem federal agency actions unlawful if they\u2019re found to be \u201carbitrary\u201d and \u201ccapricious.\u201d<\/p>\n

On his first day, Trump also\u00a0declared a so-called \u201cnational energy emergency<\/a>\u201d in an\u00a0executive order<\/a>\u00a0to promote the development of fossil fuel projects. \u201cThese and numerous other executive actions similarly encouraged domestic energy development\u2014that is, all but wind and other renewable energy,\u201d the\u00a0complaint<\/a>\u00a0says.<\/p>\n

The Trump administration, meanwhile, is framing the lawsuit as a partisan attack. \u201cInstead of working with President Trump to unleash American energy and lower prices for American families, Democrat Attorneys General are using lawfare to stop the President\u2019s popular energy agenda,\u201d White House spokesperson Taylor Rogers said in an email to\u00a0The Verge<\/em>. \u201cAmericans in blue states should not have to pay the price of the Democrats\u2019 radical climate agenda.\u201d<\/p>\n

The states also claim that the Trump administration is abruptly reversing longstanding policy after federal agencies have already assessed the potential benefits and risks of wind energy projects. Trump\u2019s presidential memorandum calls for a new review of federal permitting processes and the purported environmental and economic \u201cnecessity of terminating or amending any existing wind energy leases.\u201d The plaintiffs allege that the Trump administration is failing to follow existing environmental rules regulating industry, including the Clean Air Act and the Clean Water Act.<\/p>\n","protected":false},"excerpt":{"rendered":"
